Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ImagineUs mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

XTC-TEK ("we", "our", or "us") reserves the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years of age to use ImagineUs. If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have a parent or guardian's consent to use the App.

3. Account Registration

When creating an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content and Conduct

You retain ownership of photos and content you upload to ImagineUs. By uploading content, you grant us a limited license to process and store it solely for the purpose of providing the App's services (AI generation, image storage, etc.).

You agree not to:

• Upload content that is illegal, harmful, abusive, or violates others' rights
• Use AI-generated images to impersonate, harass, or deceive others
• Upload photos of individuals without their explicit consent
• Attempt to reverse-engineer, exploit, or disrupt the App's services
• Use the App for any commercial purpose without our written consent

5. AI-Generated Content

ImagineUs uses artificial intelligence to generate images based on your inputs. You acknowledge that:

• AI-generated images may vary in quality and accuracy
• Generated images are for personal entertainment purposes
• We do not guarantee specific results or outcomes
• AI-generated content should not be used for official identification, legal, or medical purposes

6. Virtual Currency and Purchases

ImagineUs offers virtual currency ("gems" or "credits") for purchase through the App. By making a purchase:

• All purchases are final and non-refundable, except as required by applicable law
• Virtual currency has no real-world monetary value and cannot be redeemed for cash
• We reserve the right to modify pricing and gem packages at any time
• Gems may expire if not used within a reasonable period (see in-app terms)

Payment processing is handled by Stripe. We do not store your payment card details.

7. Intellectual Property

ImagineUs, its branding, design, and underlying code are the intellectual property of XTC-TEK. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Third-Party Services

The App integrates with third-party services including Google Sign-In, Google AdMob, Stripe payments, and AI generation APIs. We are not responsible for the content, functionality, or practices of these third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, XTC-TEK shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. The App is provided "as is" without warranties of any kind, express or implied.

10. Termination

You may stop using the App and delete your account at any time via the in-app settings or our account deletion page. We may suspend or terminate your access to the App at any time for violation of these Terms.

11. Governing Law

These Terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Hamburg, Germany, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
